Simple method for measuring PFCs1
Seiko Epson Corporation ("Epson") has developed a simple method for measuring PFCs (Perfluorocarbon) usage. Documents detailing Epson's simple method and sheets for measuring PFCs usage (collectively "Measuring PFCs Documents") will be sent to you by e-mail after you agree to the terms and condition of this Agreement and fill out the "Simple method for measuring PFCs Documents Application Form".
Epson retains ownership of all intellectual property right (including patent rights, applications for patent right, copyright and know-how) relating to the simple method for measuring PFCs usage and Measuring PFCs Documents. Subject to the Agreement, you may use the Simple method for measuring PFCs.
This Agreement is composed of "The License Terms of Simple method for measuring PFCs" and "Privacy Policy/Statement". If you click the "Agree to Terms and Conditions" button on this page and "Confirm" button on Privacy Policy/Statement page, you are expressing and warranting that you are consenting to be bound by, and you have become a party to this Agreement. If you do not agree to (or cannot comply with) all of the terms of this Agreement, click the "Not Agree" button, and you shall not authorized to use the Simple method for measuring PFCs.
If you desire to use the Simple method for measuring PFCs for the purpose other than the Purpose (defined in Section 1 of the Rules of Simple method for measuring PFCs Usage), please contact the following address.

License Terms for the Simple method for measuring PFCs
1.
Subject to and conditional upon the terms of this Agreement, Epson grants you non-sublicensable, non-exclusive, fully paid-up and limited license to use the Simple method for measuring PFCs only for the purpose of measuring PFCs which are emitted from your plants ("Purpose").
2. You may not use the Simple method for measuring PFCs for the purpose other than the Purpose. If you desire to use the Simple method for measuring PFCs for the purpose other than the Purpose, please contact the address above.
3. You shall, without delay, disclose to Epson all inventions (including improvement inventions) and creations in connection with the Simple method for measuring PFCs (collectively "Inventions"). You shall grant Epson and all Simple method for measuring PFCs users a non-exclusive, royalty-free, fully paid-up, world wide and non-exclusive license to make, use, sell, offer, copy, modify, import and distribute, directly or indirectly, the Inventions.
4. You shall clearly indicate that the Simple method for measuring PFCs was used on any measurement reports submitted to industry groups.
5. You shall not disclose or publish the Measuring PFCs Documents to a third party without the Epson's prior written approval.
6. You shall not copy or modify the Measuring PFCs Documents without the Epson's prior written approval.
7. You shall not delete, remove or modify the copyright notices in the Measuring PFCs Documents.
8. You acknowledge and agree that use of the Simple method for measuring PFCs is at your sole risk. The Simple method for measuring PFCs is provided "as is" and without any warranty whatsoever, including without limitation, warranties of merchantability, fitness for a particular purpose and/or non-infringement of the rights of a third party (including without limitation rights under patent, copyright and trade secrets). further, Epson does not warrant, guarantee, or make any representations (a) the Simple method for measuring PFCs's performance or results of measurements obtained using the Simple method for measuring PFCs, or (b) that any documentation (including Measuring PFCs Documents) are correct, accurate or reliable.
9. In no event shall Epson be liable to you or any third party with respect to any subject matter of this agreement whether arising under contract, tort (including negligence), strict liability, breach of warranty, or misrepresentation for: (a) any indirect, incidental, or consequential damages, including, but not limited to, loss of profits; or any matter beyond Epson's reasonable control; or (b) any direct damages exceeding the amounts paid by you to Epson to use the Simple method for measuring PFCs hereunder.
10. Epson shall not be liable for any claims, liabilities, losses, damages, costs and/or expenses (collectively, "Damages") arising out of or in connection with the Simple method for measuring PFCs. Epson shall have no obligation to you and/or any third party to indemnify, contribute, defend or hold harmless you and/or any third party from and against any and all Damages arising out of the Simple method for measuring PFCs. You shall defend, hold harmless and indemnify Epson from and against all Damages arising out of the Simple method for measuring PFCs.
11. This Agreement is effective until it is terminated. This Agreement will terminate automatically if you fail to comply with any provision of this Agreement. You may also terminate this Agreement at any time. Upon termination of this Agreement, you shall stop all use of the Simple method for measuring PFCs. In addition, you shall return the Measuring PFCs Documents to Epson, on Epson's instructions. Except as otherwise provided herein, the terms of this Agreement shall survive termination. Termination is not an exclusive remedy, and any and all other remedies shall be available whether or not this Agreement is terminated.

Terms and Conditions for Handling Personal Information
1. Method of obtaining personal information
Seiko Epson will collect your personal information when you enter your personal information in the "Application Form for PFC Gas Simple Measurement Method Materials".
Personal information in this Agreement refers to the name of the customer's company/organization, industry, affiliation, name, e-mail address, and the purpose of use of the PFC gas simple measurement method, which can be used to identify the individual customer alone or in combination with such information.
Please note the following points when applying using the "PFC Gas Simple Measurement Method Document Application Form".
(i) If the browser you are using is a browser that does not support SSL, there is an increased risk that the information will be viewed or stolen by a third party outside the control of Seiko Epson in the process of reaching the Seiko Epson when you apply using the "Application Form for PFC Gas Simple Measurement Method". Please be aware of this before using these means.
(ii) If your e-mail software has a function to confirm the arrival and opening of e-mails, Seiko Epson may receive and record information about the arrival and opening of e-mails sent to you. If you do not want Seiko Epson to receive such information, please disable the verification function of your e-mail software or use an e-mail software that does not have a verification function.
2. Purpose of Use of Acquired Personal Information
Seiko Epson acquires personal information for the purpose of understanding and confirming the actual usage of the PFC gas simple measurement method (what kind of customers are using it, for what purpose, and in what method) and for the purpose of improving the PFC gas simple measurement method (hereinafter referred to as the "purpose of use of personal information").
Personal information will not be used for any purpose other than the purpose of use, except as otherwise provided in this Agreement or with the prior consent of the customer.
Seiko Epson may use the e-mail address you provide to confirm the details of the use of the PFC gas simple measurement method.
3. Use of personal information for purposes other than those used
Seiko Epson may use personal information even if it is not for the purpose of use of personal information in the following cases.
(i) as required by law;
(ii) When it is necessary to protect the life, body, or property of an individual and it is difficult to obtain the consent of the person.
(iii) When it is necessary to cooperate with a national agency, a local government, or an individual or entity entrusted by either of the foregoing in executing the affairs prescribed by laws and regulations, and obtaining the consent of the person is likely to interfere with the execution of the affairs.
4. Provision of Personal Information to Third Parties
Seiko Epson will not provide personal information to third parties except with the consent of the customer or in cases falling under any of the items of the preceding paragraph. However, Seiko Epson may provide statistical data processed into a form that does not identify or identify individuals to a third party or make it available to the public.
5. Changes to the Terms of Handling of Personal Information
Seiko Epson reserves the right to change these terms and conditions for handling personal information. In that case, we will notify you by e-mail or make a public announcement by changing this agreement.
6. Where to file a complaint, etc.
If you are requested to disclose the scope of use of personal information held by Seiko Epson or the content of personal information, please contact the following personal information management desk. After confirming your identity, we will promptly carry out procedures such as disclosure of personal information within a reasonable range.

7. Disposal of personal information
Seiko Epson will appropriately manage personal information provided by customers and dispose of it appropriately after use.
